Our Policy

This statement is issued by Afresh Yoga Company Limited (the "Company") in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of the Hong Kong Special Administrative Region ("Ordinance"). The Company is committed to ensuring that all personal data collected during member registration is handled in compliance with the Ordinance. Prior to collecting personal data from members, the Company will provide this Personal Data Collection Statement for members' review.

Categories of Personal Data Collected and Purposes of Collection

1.The Company collects personal data from members to provide services or products. The data collected includes, but is not limited to: (a) the member's name; (b) the member's contact phone number and email; (c) emergency contact information; and (d) the member's health status. Members are not obligated to provide personal data to the Company; however, failure to do so may hinder the Company's ability to deliver the requested services or products.

2.Members' personal data may be used for the following purposes: (a) verifying member identity; (b) providing products and services to members; (c) managing the products and services offered to members; (d) notifying members of updates related to the Company’s products and services; (e) addressing member inquiries, complaints, and feedback; (f) conducting routine business monitoring and management; (g) contacting members via email, phone, mail, or other means; (h) accounting purposes; (i) seeking legal advice and making legal claims or defenses in legal proceedings; (j) preventing and investigating fraud and other criminal activities; (k) disclosing as required by law, regulations, court orders, or any request from government, regulatory bodies, or law enforcement agencies; and/or (l) any other purposes related to the above or as consented to by members from time to time.

Disclosure of Personal Data

The Company may transfer, disclose, or share members' personal data (whether within or outside Hong Kong) to achieve the purposes stated above. This personal data may be transferred to: (a) any holding company, subsidiary, affiliate, or company under common control with the Company; (b) any individual or entity representing the Company or associated with the Company to facilitate the provision of such data or for related purposes; (c) any other person or entity legally entitled to access the data and responsible for maintaining its confidentiality; (d) the Company's professional advisors, including accountants, auditors, and lawyers; (e) government and regulatory bodies, law enforcement agencies, and other organizations as mandated or authorized by law; and (f) any potential or actual participants, assignees, or transferees related to all or part of the Company's business operations.
The Company's waiting area and classrooms are equipped with monitoring systems that have recording capabilities. Data stored by these systems will only be accessed in accordance with Section 58 of the Ordinance, when the Company is required to provide relevant video footage to law enforcement agencies (e.g., police) for criminal investigations.

Use and Transfer of Personal Data

Collected personal data will not be used for any purposes beyond those originally specified or directly related, unless prior consent is obtained from the data subject or such use is exempt under Part 8 of the Ordinance.

Safeguarding and Retention of Personal Data

The Company will take all reasonable and practicable measures to ensure that all personal data is accurate, secure, and confidential, preventing unauthorized or accidental access, processing, deletion, or other use, in compliance with the relevant regulations concerning data correction and access.
The Company will retain personal data for as long as necessary to fulfill the purposes for which it was collected, in accordance with the relevant Ordinance. After this retention period, personal data will be securely deleted.

Access and Correction Requests

Members have the right to access their personal data. If a member wishes to obtain a copy of such data or believes that the Company has collected and retained inaccurate personal data, they may contact the Company via WhatsApp at 6061-7787. However, the Company reserves the right to refuse access to data requests under the circumstances specified in Section 20 of the Ordinance.
Requests for access or correction of personal data, or inquiries regarding the Company's policies and practices concerning the collection of customer personal data, can also be made via WhatsApp at 6061-7787. The Company reserves the right to charge a reasonable fee for processing data access requests in accordance with privacy regulations.

Changes to This Statement

The Company reserves the right to unilaterally modify this Personal Data Collection Statement at any time without prior notice, and any revisions will be posted on this webpage. Members are advised to regularly check the Company’s website for any updates to this statement. In the event of any discrepancies between versions published in different media, the version on this webpage shall prevail.
